Tmoji App Terms and Conditions

Please read these Terms and Conditions ("Terms") carefully before using the Tmoji mobile application ("the App").

1. Acceptance of Terms

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.

2. App Description and Usage

Tmoji is a text-to-emoji encoding application designed for entertainment purposes. The App is NOT a messaging application. It only converts text into emoji sequences for encoding purposes. The App is provided for personal, non-commercial use. You agree to use the App only for lawful purposes and in accordance with these Terms.

3. User Responsibility and Liability

You are solely responsible for any content you encode using the App and any consequences that may arise from sharing or using such encoded content. You acknowledge and agree that:

• The developer assumes no responsibility for any harm, damage, or legal consequences that may result from the use of encoded messages
• You will not use the App to encode illegal, harmful, threatening, abusive, or otherwise objectionable content
• You are fully responsible for ensuring that your use of the App complies with all applicable laws and regulations
• Any misuse of the encoded content is your sole responsibility

4. Intellectual Property

The App, including its content, features, and functionality, is owned by Tmoji and is protected by intellectual property laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material in the App, except as generally and ordinarily permitted through the App according to these Terms.

5. User Accounts

The App does not require user registration or account creation. No login credentials are needed to access the App's features.

6. No Data Collection

As outlined in our Privacy Policy, the Tmoji App does not collect any user data. All text-to-emoji encoding operations are performed locally on your device and are not transmitted to our servers or any third parties.

7. App Updates

We may from time to time provide updates to the App. These updates may include bug fixes, feature improvements, or new functionalities. You agree that we have no obligation to provide any updates to the App.

8. Third-Party Links

The App may contain links to third-party websites or services that are not owned or controlled by Tmoji. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services.

9. Disclaimer of Warranties

The App is provided "as is" and "as available," without any warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted or error-free, that defects will be corrected, or that the App is free of viruses or other harmful components.

10. Limitation of Liability

In no event shall Tmoji or its developers be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use the App
• Any content encoded using the App
• Any harm or damage caused by the misuse of encoded content
• Any legal consequences arising from the use of encoded messages

11. Prohibited Uses

You agree not to use the App for any unlawful purpose or any purpose prohibited under these Terms. Prohibited uses include but are not limited to:

• Encoding content that is illegal, harmful, threatening, abusive, or defamatory
• Using the App to harass, intimidate, or harm others
• Encoding content that violates any applicable law or regulation
• Using the App for any commercial purpose without express written consent

12. Termination

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.

13. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect.
